تنظم هذه الشروط استخدام تطبيق TOGER وموقعه وخدماته المرتبطة. يُدار TOGER بواسطة مطوّر مستقل في المملكة العربية السعودية. باستخدام الخدمة أو إنشاء حساب، فإنك توافق على هذه الشروط وسياسة الخصوصية. إذا لم توافق، فلا تستخدم TOGER.
1. الأهلية
يجب أن يكون عمرك 18 عامًا على الأقل لاستخدام TOGER. وبإنشاء حساب، فإنك تقر بأن المعلومات التي تقدمها صحيحة وأنك مؤهل نظامًا للموافقة على هذه الشروط.
2. وصف الخدمة
يساعد TOGER المستخدم على حفظ العناصر والفواتير والصور والمستندات وتنظيمها والبحث فيها، وتسجيل تواريخ مثل الشراء والضمان والاسترجاع والاستبدال والانتهاء، وإنشاء التذكيرات. وقد يوفر التطبيق ميزة اختيارية لاستخراج بيانات الفاتورة بالذكاء الاصطناعي بعد موافقة المستخدم.
قد تختلف بعض الميزات بحسب المنصة أو الدولة أو إصدار التطبيق، وقد نضيف ميزات أو نعدّلها أو نوقفها مع مراعاة الأنظمة المعمول بها. الميزات المستقبلية أو المدفوعة لا تُعد متاحة أو مضمونة لمجرد ذكرها في مواد تعريفية أو خطط تطوير.
3. الحساب وأمانه
أنت مسؤول عن:
تقديم معلومات حساب صحيحة وتحديثها عند الحاجة.
حماية كلمة المرور والجهاز ووسائل تسجيل الدخول.
جميع الأنشطة التي تتم من خلال حسابك ما لم تبلغنا عن وصول غير مصرح به.
لا يجوز مشاركة الحساب بطريقة تعرض بياناتك أو بيانات الآخرين للخطر.
4. محتوى المستخدم وملكيته
تحتفظ بملكية الملفات والصور والفواتير والملاحظات والمعلومات التي تضيفها إلى TOGER. تمنح TOGER ومزودي الخدمة التابعين له ترخيصًا محدودًا وغير حصري لمعالجة هذا المحتوى فقط بالقدر اللازم لتخزينه ومزامنته وعرضه والبحث فيه وإنشاء التذكيرات وتقديم الميزات التي تختارها.
أنت تقر بأن لديك الحق النظامي في رفع المحتوى ومعالجته، وأنه لا ينتهك حقوق الآخرين أو خصوصيتهم. لا ترفع مستندات أو بيانات تخص شخصًا آخر دون إذن أو أساس نظامي مناسب.
5. الاستخدامات المحظورة
لا يجوز استخدام TOGER من أجل:
مخالفة الأنظمة أو حقوق الملكية الفكرية أو الخصوصية.
رفع برمجيات ضارة أو محتوى يهدف لاختراق الخدمة أو تعطيلها.
محاولة الوصول إلى حسابات أو ملفات مستخدمين آخرين.
التحايل على حدود الخدمة أو ضوابط الأمان أو استخراج الشفرة أو إساءة استخدام الواجهات.
استخدام الخدمة لمعالجة محتوى غير قانوني أو احتيالي أو ضار.
تقديم معلومات مضللة عن الهوية أو ملكية المحتوى.
يجوز لنا تقييد الوصول أو تعليق الحساب عند وجود مخالفة جوهرية أو خطر أمني، مع مراعاة الأنظمة المعمول بها.
6. الذكاء الاصطناعي ودقة الاستخراج
ميزة معالجة الفواتير بالذكاء الاصطناعي اختيارية. النتائج التي تقدمها الميزة مسودة مساعدة وليست حقيقة مضمونة. قد تكون البيانات ناقصة أو غير دقيقة، ويجب على المستخدم مراجعة اسم المنتج والتاجر والمبلغ والتواريخ والضمان والاسترجاع والاستبدال وجميع الحقول قبل الحفظ أو الاعتماد عليها.
لا يتحمل TOGER مسؤولية قرار اتخذه المستخدم اعتمادًا على نتيجة لم يراجعها أو يصححها. تبقى الفاتورة الأصلية وشروط البائع أو المصنع أو الجهة المصدرة هي المرجع الأساسي.
7. التذكيرات والإشعارات
يقدم TOGER التذكيرات كأداة مساعدة فقط. قد تتأخر الإشعارات أو لا تصل لأسباب تشمل إعدادات الجهاز، أو رفض الإذن، أو وضع توفير الطاقة، أو الاتصال، أو خدمات Apple وGoogle وFirebase، أو توقف الخدمة، أو إدخال تاريخ غير صحيح.
أنت مسؤول عن التحقق من المواعيد المهمة والرجوع إلى المستند الأصلي والجهة المعنية. لا يضمن TOGER استرداد مبلغ أو قبول ضمان أو استبدال أو تجديد أو تجنب غرامة لمجرد إنشاء تذكير.
8. المستندات الصحية والمالية وغيرها
TOGER أداة للتخزين والتنظيم وليس جهة طبية أو مالية أو قانونية، ولا يقدم تشخيصًا أو علاجًا أو استشارة مهنية. أي معلومات صحية أو مالية أو قانونية يحفظها المستخدم داخل التطبيق تكون لأغراضه التنظيمية، ويجب الرجوع إلى مختص مؤهل أو الجهة المصدرة قبل اتخاذ قرار مهم.
9. خدمات الجهات الأخرى
تعتمد بعض وظائف TOGER على خدمات جهات أخرى مثل Google Firebase وGoogle Sign-In وApple وOpenAI. قد تخضع هذه الخدمات لشروط وسياسات مستقلة، وقد تتأثر الخدمة بانقطاعها أو تغييرها. لا يسيطر TOGER على البنية التقنية لتلك الجهات، لكنه يختار مزودي الخدمة ويستخدمهم لتقديم وظائف التطبيق.
تسجيل الدخول عبر Apple متاح حيث تدعمه المنصة، وهو متاح حاليًا على iOS وmacOS، ولا يتوفر حاليًا على Android.
10. توافر الخدمة والتحديثات
نسعى لتوفير TOGER بصورة مستقرة وآمنة، لكن لا نضمن أن الخدمة ستكون متاحة دون انقطاع أو خطأ في جميع الأوقات. يجوز تنفيذ صيانة أو تحديثات أو تغييرات ضرورية للأمان أو التوافق أو تحسين الأداء.
قد تتطلب بعض التحديثات نظام تشغيل أو إصدار تطبيق حديثًا. ويتحمل المستخدم مسؤولية تحديث التطبيق وجهازه بالقدر المعقول للاستفادة من الخدمة وحماية الحساب.
11. حذف المحتوى والحساب
يمكن حذف العناصر والمستندات من داخل التطبيق وفق الخيارات المتاحة. وقد تبقى العناصر المحذوفة مؤقتًا في سلة المحذوفات حتى يحذفها المستخدم نهائيًا أو يحذف الحساب.
يمكن طلب حذف الحساب من الملف الشخصي أو الإعدادات ← حذف الحساب، أو عبر صفحة حذف الحساب على https://gettoger.com/delete-account/، أو بإرسال طلب من بريد الحساب إلى support@gettoger.com. يؤدي حذف الحساب إلى فقدان الوصول إلى المحتوى والتذكيرات، وتُجدول البيانات المرتبطة للحذف النهائي خلال مدة تصل إلى 30 يومًا، وفق سياسة الخصوصية والأنظمة المعمول بها.
12. الملكية الفكرية
يمتلك TOGER أو المرخصون له الحقوق المتعلقة باسم التطبيق وشعاره وتصميمه وبرمجياته ونصوصه وعناصره الأصلية، باستثناء محتوى المستخدم. لا تمنحك هذه الشروط حق نسخ التطبيق أو إعادة بيعه أو تعديل علامته أو استخدام أصوله خارج الاستخدام العادي للخدمة.
13. إخلاء المسؤولية وحدودها
يُقدَّم TOGER وفق حالته المتاحة وكأداة تنظيمية مساعدة، إلى الحد الذي تسمح به الأنظمة. لا نقدم ضمانًا مطلقًا لدقة الاستخراج أو وصول التذكيرات أو استمرار الخدمة بلا انقطاع.
إلى الحد الذي تسمح به الأنظمة المعمول بها، لا يكون TOGER مسؤولًا عن الأضرار غير المباشرة أو التبعية الناتجة عن فقد موعد أو اعتماد غير مُراجع على نتيجة ذكاء اصطناعي أو عطل خارج السيطرة المعقولة. ولا تستبعد هذه الشروط أي حق أو مسؤولية لا يجوز استبعادها بموجب أنظمة حماية المستهلك أو الأنظمة الإلزامية.
14. التعويض عن المخالفات
إلى الحد المسموح نظامًا، يكون المستخدم مسؤولًا عن الضرر المباشر الناتج عن استخدامه غير النظامي للخدمة أو رفعه محتوى لا يملك حق استخدامه أو مخالفته حقوق الآخرين. لا يحد هذا البند من الحقوق النظامية لأي طرف.
15. إيقاف الحساب
يجوز لنا تقييد الحساب أو تعليقه أو إنهاؤه عند وجود مخالفة جوهرية لهذه الشروط، أو نشاط احتيالي، أو خطر أمني، أو طلب نظامي صحيح. سنراعي، متى كان ذلك مناسبًا ومسموحًا، إشعار المستخدم وإتاحة وسيلة للتواصل.
16. تغييرات الشروط
قد نحدّث هذه الشروط عند تغيير الخدمة أو المتطلبات النظامية. سننشر النسخة المحدثة مع تاريخ آخر تحديث، وقد نطلب موافقة جديدة إذا كان التغيير جوهريًا. استمرار الاستخدام بعد نفاذ التحديث يعني قبول الشروط المحدثة عندما يسمح النظام بذلك.
17. النظام المختص
تخضع هذه الشروط لأنظمة المملكة العربية السعودية. وتختص الجهات والمحاكم المختصة في المملكة بالنزاعات، مع عدم الإخلال بأي حقوق إلزامية للمستهلك لا يجوز الاتفاق على مخالفتها.
18. اللغة
تتوفر هذه الشروط بالعربية والإنجليزية. عند وجود اختلاف في التفسير، تسود النسخة العربية بالقدر الذي تسمح به الأنظمة المعمول بها.
These Terms govern your use of the TOGER application, website, and related services. TOGER is operated by an independent developer in the Kingdom of Saudi Arabia. By using the service or creating an account, you agree to these Terms and the Privacy Policy. If you do not agree, do not use TOGER.
1. Eligibility
You must be at least 18 years old to use TOGER. By creating an account, you represent that the information you provide is accurate and that you have legal capacity to accept these Terms.
2. The Service
TOGER helps users store, organize, and search Saved Items, invoices, images, and documents; record dates such as purchase, warranty, return, exchange, expiration, maintenance, and renewal dates; and create reminders. The app may offer optional AI-powered invoice extraction after the user provides the required consent.
Features may vary by platform, country, or app version. We may add, change, or discontinue features subject to applicable law. Future or paid features are not available or guaranteed merely because they appear in informational materials or development plans.
3. Accounts and Security
You are responsible for:
Providing accurate account information and updating it when necessary.
Protecting your password, device, and sign-in methods.
Activity through your account unless you notify us of unauthorized access.
You must not share an account in a way that puts your data or another person’s data at risk.
4. User Content and Ownership
You retain ownership of files, images, invoices, notes, and information you add to TOGER. You grant TOGER and its service providers a limited, non-exclusive license to process that content only as reasonably necessary to store, synchronize, display, search, create reminders, and provide the features you choose.
You represent that you have the legal right to upload and process the content and that it does not violate another person’s rights or privacy. Do not upload another person’s documents or personal data without permission or another appropriate legal basis.
5. Prohibited Uses
You must not use TOGER to:
Violate law, intellectual-property rights, or privacy rights.
Upload malware or content designed to compromise or disrupt the service.
Attempt to access another user’s account or files.
Circumvent service limits or security controls, reverse engineer the service where prohibited, or misuse interfaces.
Process unlawful, fraudulent, or harmful content.
Misrepresent identity or ownership of content.
We may restrict or suspend access for a material violation or security risk, subject to applicable law.
6. AI Processing and Extraction Accuracy
AI-powered invoice processing is optional. Its output is an assisted draft, not guaranteed fact. Extracted information may be incomplete or inaccurate. You must review the item name, merchant, amount, dates, warranty, return, exchange, and every other field before saving or relying on it.
TOGER is not responsible for a decision made based on an output you did not review or correct. The original invoice and the seller’s, manufacturer’s, or issuer’s terms remain the primary source.
7. Reminders and Notifications
TOGER provides reminders as an organizational aid only. Notifications may be delayed or not delivered because of device settings, denied permission, battery optimization, connectivity, Apple, Google or Firebase services, service interruption, or an incorrect date entered by the user.
You are responsible for checking important dates and referring to the original document and relevant provider. TOGER does not guarantee a refund, warranty acceptance, exchange, renewal, or avoidance of a fee merely because a reminder was created.
8. Health, Financial, and Other Documents
TOGER is a storage and organization tool, not a medical, financial, or legal provider, and does not provide diagnosis, treatment, or professional advice. Health, financial, or legal information stored by a user is for the user’s organizational purposes. Consult a qualified professional or issuing authority before making an important decision.
9. Third-Party Services
Some TOGER functions rely on services provided by Google Firebase, Google Sign-In, Apple, and OpenAI. Those services may be governed by separate terms and policies, and TOGER may be affected by their availability or changes. TOGER does not control third-party infrastructure but selects and uses providers to deliver app functions.
Sign in with Apple is available where the platform supports it; it is currently available on iOS and macOS and is not currently available on Android.
10. Availability and Updates
We aim to provide a stable and secure service, but do not guarantee uninterrupted or error-free availability at all times. We may perform maintenance, updates, or changes required for security, compatibility, and performance.
Some updates may require a current operating system or app version. You are responsible for reasonably updating your app and device to receive the service and protect your account.
11. Content and Account Deletion
You may delete items and documents through available in-app options. Soft-deleted items may remain in Trash until you permanently delete them or delete your account.
You may request account deletion from Profile or Settings → Delete Account, through the account-deletion page at https://gettoger.com/delete-account/, or by emailing support@gettoger.com from the account email. Account deletion results in loss of access to content and reminders, and associated data is scheduled for permanent deletion within up to 30 days according to the Privacy Policy and applicable law.
12. Intellectual Property
TOGER or its licensors own rights in the app name, logo, design, software, text, and original elements, excluding User Content. These Terms do not grant you a right to copy, resell, rebrand, or use TOGER assets beyond ordinary use of the service.
13. Disclaimers and Limitation of Liability
TOGER is provided as available and as an organizational aid, to the extent permitted by law. We do not provide an absolute guarantee of extraction accuracy, reminder delivery, or uninterrupted service.
To the extent permitted by applicable law, TOGER is not liable for indirect or consequential loss resulting from a missed deadline, unreviewed reliance on AI output, or an event outside reasonable control. These Terms do not exclude any consumer right or liability that cannot legally be excluded.
14. Responsibility for Violations
To the extent permitted by law, you are responsible for direct harm caused by your unlawful use of the service, uploading content you are not authorized to use, or violating another person’s rights. This section does not limit any mandatory legal right of either party.
15. Suspension and Termination
We may restrict, suspend, or terminate an account for a material breach of these Terms, fraudulent activity, a security risk, or a valid legal request. Where appropriate and permitted, we will provide notice and a way to contact us.
16. Changes to These Terms
We may update these Terms when the service or legal requirements change. We will publish the updated version with a new last-updated date and may request renewed acceptance for a material change. Continued use after an update takes effect constitutes acceptance where permitted by law.
17. Governing Law
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Competent authorities and courts in the Kingdom have jurisdiction, without limiting any mandatory consumer rights that cannot be waived by agreement.
18. Language
These Terms are available in Arabic and English. If there is a conflict in interpretation, the Arabic version controls to the extent permitted by applicable law.
